By accessing or using Vivacantus (“the Service”) at www.vivacantus.com, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
Vivacantus is a web application that allows authorised users (“admins”) to create and manage liturgical texts and display them in real time on the devices of congregation members (“viewers”). The Service is intended for use in religious and liturgical settings, primarily Catholic worship.
We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
To use the admin features of Vivacantus, you must register an account. By registering, you agree to:
You are responsible for all activity that occurs under your account.
You agree to use the Service only for lawful purposes and in a manner consistent with its intended liturgical use. You must not:
You retain ownership of the liturgical texts, book content, and other material (“User Content”) that you create within Vivacantus. By submitting User Content, you grant ArtinCatholic a non-exclusive, royalty-free licence to store, display, and transmit that content solely for the purpose of providing the Service to you.
Copyright responsibility: Many official Catholic liturgical texts — including translations of the Roman Missal, lectionary readings, and other approved texts — are protected by copyright held by the relevant Bishops’ Conference, publishers, or the Holy See. You are solely responsible for ensuring that any text you enter into Vivacantus is either your own original work, in the public domain, or used with appropriate permission or licence. ArtinCatholic does not verify the copyright status of User Content and accepts no liability for any copyright infringement.
The Vivacantus software, design, and codebase are the intellectual property of ArtinCatholic. Nothing in these Terms grants you any right to use our name, logo, or trademarks without our prior written consent.
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that defects will be corrected.
Nothing in these Terms limits any rights you may have under Australian Consumer Law that cannot be excluded by contract.
To the maximum extent permitted by applicable law, ArtinCatholic and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or disruption to your liturgical services, arising from your use of or inability to use Vivacantus.
Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you have paid to us (if any) in the twelve months preceding the claim. As Vivacantus is currently a free service, this amount is $0.
You may delete your account at any time from within the application. Upon deletion, all your data is permanently removed.
We reserve the right to suspend or terminate your account without notice if we believe you have violated these Terms or are using the Service in a way that could cause harm to others or to the Service itself.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
We may update these Terms from time to time. The “Effective date” at the top of this page will reflect the date of the most recent revision. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
